The Surf House / Booking conditions
General Terms and Conditions
These are the General Terms and Conditions applicable to any stays booked with Blacksand Ltd (‘Surfhouse Taiwan’). Any person or persons booking with Surfhouse Taiwan (‘Guests’) should read these conditions carefully prior to making any booking. An invalidity of any section of these Terms and Conditions does not influence the validity of the remainder of the General Terms and Conditions.
These Terms and Conditions are governed by Dutch law. Any dispute regarding these General Terms and Conditions should be filed with the Court of First Instance in Amsterdam (‘Rechtbank Amsterdam’). Parties to these Terms and Conditions agree that the applicable law is Dutch law and the only court with capacity to hear disputes regarding these General Terms and Conditions, and bookings made subject to it, is the Court of First Instance in Amsterdam.
- Booking
A booking with Surfhouse Taiwan results in a legally binding agreement between Blacksand Ltd and the person or persons making the booking. The guest is obliged to read the General Terms and Conditions and accept these. In case the guest is making a booking on behalf of a group, this person must have the authority to sign on behalf of the group. The signing person is responsible for the full price agreed, including any insurance, claims, cancellations, and amendment changers. The agreement between the person or persons is concluded once the booking form is received.
Blacksand Ltd reserves the right to refuse any booking. In case Blacksand Ltd exercises this right, it does so with absolute discretion and can do so without stating any reason.
The minimum age for booking with Blacksand Ltd is 18 years old.
- Risk
Booking with Blacksand Ltd includes a waiver of any risk. Guest booking with Blacksand Ltd are aware of this and agree with the waiver upon sending the booking request.
Surfing poses inherent risks. By booking with Blacksand Ltd the person or persons booking with Blacksand Ltd acknowledge these risks and accepts these risks for themselves. Blacksand Ltd is not responsible for any damages that result from the surf. Persons booking with Blacksand Ltd are under an obligation to enquire on these risk and place due consideration on the risk. No liability exists for any damages resulting from the surf between the person or persons staying at Surfhouse Taiwan and Blacksand Ltd or its representatives.
Blacksand Ltd provides use of surf equipment to any guest staying at Surfhouse Taiwan. Blacksand Ltd nor its representatives are liable for any injury, loss, damages, accident, delay, irregularity or cost that results from the use of this equipment. Moreover, Blacksand Ltd nor its representatives assume liability for any injury, loss, damages, accidents, delays, irregularity or costs that results from other activities undertaken by the person or persons staying at Surfhouse Taiwan.
Guests can make booking with Surfhouse Taiwan via service providers. Blacksand Ltd accepts no responsibility for any omission, default, neglect, or accuracy for any statement or information provided by these service providers. Any agreements or booking made with these service providers do not influence the validity of these General Terms and Conditions.
Any damages caused by persons while staying at Surfhouse Taiwan is that guest own risk, including any damage to property of Blacksand Ltd or their representatives and any damages caused to third parties using Blacksand Ltd’s property (not excluding surfboard, cars, motorbikes, and bikes).
- Price
The prices on the website are in euro’s. Once a booking has been accepted by Blacksand Ltd, the person or persons making the booking are liable to payment. Once a booking has been made discount cannot be applied with retroactive effect. Blacksand Ltd reserves the right to adjust the price on the website at any moment. Such changes will not affect any bookings accepted by Blacksand Ltd prior to such change.
The moment of payment will take place on a mutually agreed upon moment, but no later than the last day of the booking. Payment can take place either in cash or via bank transfer. Payments in cash are made in Taiwan Dollars in person by the guest making the booking. Payments in certain cryptocurrencies are accepted as a secondary method of payment, Blacksand Ltd reserves to right to require payment in cash or bank transfer instead of cryptocurrency without stating any reason to do so.
- Cancellations
A cancellation will be valid the moment Blacksand Ltd receives the definite notice. Cancellations cannot be made less than 30 days prior to the booked arrival date. If the cancellation is received at least 30 days before the cancellation date, a full refund will be given. No refunds are provided for cancellations within 30 days prior to the arrival date.
Blacksand Ltd and its representatives reserve the right to cancel a booking at any point prior to the end date of the booking. In case Blacksand Ltd exercises this right, the booking will be refund only insofar as the stay is cancelled.
- General
Blacksand Ltd provides transfer to and from Taitung Railway Station and Taitung Airport. No other transfers are offered nor available from Blacksand Ltd. The person booking is obliged to inform Blacksand Ltd of the moment of arrival at least 24 hours prior to arrival. If a person fails to inform Blacksand Ltd of their arrival time, it is up to the discretion of Blacksand Ltd representatives on whether or not a transfer will take place. If no transfer takes place, it is the responsibility of the person staying at Surfhouse Taiwan to arrange transport from the point of entry to Surfhouse Taiwan.
Blacksand Ltd aims to make your stay as comfortable as possible. In situations where a guests’ stay is not meeting expectations, that guest is to inform a representative of Blacksand Ltd without undue delay. Blacksand Ltd aims to resolve any problems as soon as possible but can only do so after having been informed thereof.
Blacksand Ltd does not have a magic wave machine. It is for this reason that Blacksand Ltd is technically, physically, and practically unable to make waves appear out of thin air. While Blacksand Ltd will do everything in its power, within reasonable limits, to find waves, it cannot be held responsible for a lack of waves.
If the package booked by the guest and advertised on the website offers surf guidance, Blacksand Ltd representatives will guide guests to the surf. This guidance is for informational purposes only and does not constitute expert advice, opinion and cannot be relied upon as surfing or safety advice. Blacksand Ltd nor its representatives are responsible for the safety of the guests nor for injury or death while surfing. Surfing at Surfhouse Taiwan is an own risk activity.
Guest booking with Blacksand Ltd provide Blacksand Ltd with an eternal, perpetual, and irrevocable servitude to their soul. By accepting these terms and conditions any claims by guest to the afterlife are null and void and belong to Blacksand Ltd in perpetuity.
Note that in case of a zombie apocalypse the entirety of these General Terms and Conditions becomes null and void and any booking, unless mutually agreed upon by Blacksand Ltd’s representative and the guest, ceases to exists. In case the zombies take over Taiwan, it is every man, woman, or child for themselves. Blacksand Ltd does not provide use of axes, helmets, silver bullets, or any other defense material against the supernatural in case disaster strikes. Guest will take their own precautions against the inevitable zombie apocalypse.
Blacksand Ltd does not provide surf classes. Blacksand Ltd will provide contact details of persons who can provide classes. It is up to guest staying at Surfhouse Taiwan to inform themselves of the surf conditions and assess their own capabilities, health, and fitness. In case of pre-existing health conditions, guest booking with Blacksand Ltd ought to acquire independent advice from a medical professional prior to visiting Surfhouse Taiwan. Moreover, guests booking with Blacksand Ltd must be physically fit and capable of swimming. By accepting these terms and conditions the person or persons booking with Blacksand Ltd confirms that there are no medical, physical, or other reasons preventing them from surfing or engaging in other strenuous activities (not excluding diving, hiking, or swimming).
Any guest at Surfhouse Taiwan is obliged to communicate any relevant medical information prior to arriving at Surfhouse Tainwa, including allergies, disabilities, and medical incapabilities. If the representatives of Blacksand Ltd deem, on the basis of the aforementioned information, that the person or person booking with Blacksand Ltd is unable to partake in the activities offered by Blacksand Ltd, Blacksand Ltd reserves the right to refuse or cancel the booking.
Every guest booking with Blacksand Ltd is to have a full travel insurance, liability insurance, and health insurance independent of Blacksant Ltd. This insurance should cover water and adventure sports.
Guest can inform one of the representatives of Blacksand Ltd verbally and in person that they have read these General Terms and conditions. Informing the representative hereof and providing the secret word entitles the guest and his party to a reward. This reward is personal, non-transferrable, and cannot be exchanged for anything other than the reward as indicated in these General Terms and Conditions. The secret word is ‘Bunga Bunga, boom shaka laka’. The reward consists of a solid handshake, a pat on the back, and a free breakfast at the local breakfast shop.
Guest are responsible for their own visa application. It is the guests own responsibility to ensure that the proper procedures are followed and the proper documents are acquired prior to arrival in Taiwan. Guests are in possession of a passport that is valid for at least six months beyond the date of arrival in Taiwan.
